Voicemail & Photo Consent
These Terms & Conditions ("Terms") govern the recording of a voice message ("Voicemail") and the taking of a film photograph ("Photo") at a Ziggy Alberts Album Listening Party event (each an "Event"), run by Alberts & Co. Music Pty Ltd (ABN: 14 620 430 668, registered address 21 Heathfield Road, Coolum Beach QLD 4573), trading as Commonfolk Records ("we", "us", "our"), in connection with the Ziggy Alberts fan Voicemail and Photo activation (the "Activation").
-
By recording a Voicemail on the phones provided at an Event, or by being photographed on the film cameras provided at an Event, you ("you" or the "participant") agree to be bound by these Terms. If you do not agree to these Terms, please do not record a Voicemail or take part in being photographed.
-
1. What the Activation Involves
At each Event, phones are provided for attendees to respond to a prompt question (for example, about what Ziggy's music means to them, a memory tied to his music, or how it has made them feel) by recording a voice message. Film cameras are also provided at each Event to take photographs of attendees and moments from the Event. Participation is entirely voluntary.
-
2. Consent to Recording and Use
By recording a Voicemail, or being photographed on the film cameras, at an Event, you acknowledge and agree that:
- Your Voicemail and any Photos taken of you (and any accompanying details you provide, such as your name or email) may be collected, stored, transcribed (for Voicemail), developed and scanned (for Photos), and reviewed by us and our representatives;
- Your Voicemail, or a written transcript of it, and any Photos, may be used, reproduced, edited, adapted, and published, in whole or in part, for marketing, promotional, and campaign purposes relating to Ziggy Alberts, including but not limited to our website, social media, email newsletters, advertising, press, and future single or album campaigns;
- Your Voicemail and any Photos may be used worldwide, across any media or format now known or later developed, without time limit;
- No payment, royalty, or other compensation is owed to you for the use of your Voicemail or any Photos; and
- We may edit or excerpt your Voicemail, or its transcript, or any Photos, for length, content, or clarity.
If you do not wish for your Voicemail or any Photos of you to be used in this way, please let our event staff know at the time. If you have already taken part and would like your Voicemail or Photos withdrawn, contact us at the details in Section 7 and we will do our best to exclude them.
-
3. Privacy
We respect your privacy. Any personal information collected as part of the Activation (such as your voice recording, transcript, Photos, or any details you provide alongside them) will only be used in accordance with these Terms and our Privacy Policy.
If you would like your Voicemail or Photos removed from circulation, or have questions about how your information is used, please contact us at the details listed in Section 7.
Note: while we will make reasonable efforts to remove a Voicemail or Photo upon request, we cannot guarantee removal from content that has already been published, shared, or downloaded by third parties.
-
4. Participants Under 18
The Events are accessible to all ages. However:
- Participants under the age of 18 must have the consent of a parent or guardian before recording a Voicemail or being photographed;
- By recording a Voicemail, or allowing a Photo to be taken, on behalf of, or with the involvement of, a minor in your care, you, as their parent or guardian, agree to these Terms on their behalf; and
- We reserve the right to decline to use, or to remove, any Voicemail or Photo we reasonably believe to have been recorded or taken of a minor without appropriate parental or guardian consent.
-
5. Participation Guidelines
By recording a Voicemail or taking part in being photographed, you confirm that:
- The Voicemail is your own original contribution and does not infringe any third party's rights;
- It does not contain anything unlawful, defamatory, obscene, offensive, or otherwise inappropriate; and
- You will not impersonate any other person or misrepresent your affiliation with any person or entity.
We reserve the right, at our sole discretion, to review, reject, or remove any Voicemail or Photo, and to determine which Voicemails (or transcripts) or Photos are published or featured.
-
6. General

If any part of these Terms is found to be invalid or unenforceable, the remainder will continue in full force and effect.
