Phone Booth Listening Activation - Terms & Conditions

These Terms & Conditions (“Terms”) govern your participation in the Phone Booth Listening Activation (the “Activation”), run by Alberts & Co. Music Pty Ltd (ABN: 14 620 430 668, registered address 21 Heathfield Road, Coolum Beach QLD 4573), trading as Commonfolk Records (“we”, “us”, “our”), in connection with the Ziggy Alberts fan choice single campaign.
By picking up the phone, listening to the tracks, leaving a voice message, or having your photo taken on the provided camera, you (“you” or the “participant”) agree to be bound by these Terms. If you do not agree to these Terms, please do not participate in the Activation.

1. What the Activation Involves

The Activation involves vintage rotary phones placed in selected coffee shops and venues around the world. Participants may:

  • Listen to unreleased music tracks by Ziggy Alberts;
  • Leave a voice message sharing their feedback, vote, or reaction to the tracks; and/or
  • Have their photograph taken using a film camera provided at the activation site.
  • Participation in any part of the Activation is entirely voluntary.

2. Consent to Recording and Use

By leaving a voice message and/or having your photograph taken as part of the Activation, you acknowledge and agree that:

  • Your voice recording and/or photograph (together, your “Contribution”) may be collected, stored, and reviewed by us and our representatives;
  • Your Contribution may be used, reproduced, edited, adapted, and published, in whole or in part, for marketing, promotional, and campaign purposes relating to Ziggy Alberts, including but not limited to social media, websites, email newsletters, advertising, press, and future single or album campaigns;
  • Your Contribution may be used worldwide, across any media or format now known or later developed, without time limit;
  • No payment, royalty, or other compensation is owed to you for the use of your Contribution; and
  • We may edit or excerpt your Contribution for length, content, or clarity.

If you do not wish for your voice message or photograph to be used in this way, please do not participate, or let a team member at the activation site know and we will do our best to exclude your Contribution.

3. Privacy

We respect your privacy. Any personal information collected as part of the Activation (such as your voice or image) will only be used in accordance with these Terms and our Privacy Policy.

If you would like a Contribution removed from circulation, or have questions about how your information is used, please contact us at the details listed in Section 8.

Note: while we will make reasonable efforts to remove a Contribution upon request, we cannot guarantee removal from content that has already been published, shared, or downloaded by third parties.

4. Participants Under 18

The Activation takes place in public venues and is open to all ages. However:

  • Participants under the age of 18 must have the consent of a parent or guardian before leaving a voice message or having their photograph taken.
  • By allowing a minor in your care to participate, you, as their parent or guardian, agree to these Terms on their behalf.
  • We reserve the right to decline to use, or to remove, any Contribution we reasonably believe to have been submitted by a minor without appropriate parental or guardian consent.

5. Voting and Track Selection

The Activation may invite participants to vote for their favourite of several unreleased tracks. We reserve the right to:

  • Determine the method by which votes and feedback are collected and counted;
  • Use voice message feedback, in addition to or instead of a simple vote count, to inform which track is selected as the next single; and
  • Make the final decision on which track is released, at our sole discretion. Participation in voting does not guarantee any particular outcome.

6. Venue Conduct

The Activation takes place within the premises of independent host venues (cafes and similar locations). Participants must:

  • Respect the venue, its staff, and other patrons at all times;
  • Use the phone and camera equipment provided with reasonable care; and
  • Follow any reasonable instructions provided by venue staff or our representatives.

We and the host venue are not responsible for any loss, damage, or injury arising from a participant's misuse of the equipment provided.

7. General

We may amend these Terms at any time. The version in effect at the time of your participation will apply. These Terms are governed by the laws of Queensland, Australia. If any part of these Terms is found to be invalid or unenforceable, the remainder will continue in full force and effect.
